Real Estate Law

With over 30 years of expertise, I aggressively litigate and seek resolution of a varied and often complex set of activities involving quiet title, partition, landlord/tenant, boundaries, sales and acquisitions, boundaries, easements, leasing, foreclosure defense, loan restructuring, financing, and related areas.

Partnership Disputes

It is said that conflicts in a partnership can be healthy and lead to innovation. In cases where conflict threatens the partnership and turns into a dispute, I am ready to provide a multitude of solutions from conflict resolution, to mediation, and litigation when necessary.

 

Landlord-Tenant

I handle all aspects of landlord-tenant law, including evictions, stays, unlawful detainer, security deposits, repair reimbursements, abatements, and lease termination.

 

Boundary Law

You just discovered that the fence between your house and your neighbor’s, which has been there for years, is not on the true property line. A tree could also be overgrown with portions over the boundary line. Are your property rights in jeopardy? Does your neighbor have rights in your property? I will help bring clarity to what otherwise can be a very complex legal battle.

 

Co-Ownership

Disputes between co-owners of property are bound to arise. One owner may want to sell, or someone who is not on title may claim an ownership interest. I have handled numerous quiet title cases through trial, including partitions, equitable claims, offsets and resulting trusts. Buyouts, reimbursements and related disputes can be resolved fairly if possible and litigated if necessary.

 

Mediation

Mediation gives people a quick, inexpensive way to work out their differences while addressing everyone’s needs and interests. As a neutral mediator, I can help you understand what services and strategies might be best for your dispute. I provide reduced fees for mediations involving most real estate disputes, starting at $350 per hour.

Mr. Bender has been a practicing attorney and litigator since 1991. He is past Chairman of the Business/Litigation Section of the San Mateo County Bar Association and was previously the Chair of the Real Estate Section for five years. He remains active in several legal associations.

Mr. Bender has represented numerous property owners in partition, quiet title, boundary matters, probate disputes, and business transactions.  He also has vast experience representing condominium owners and associations regarding enforcement of governing documents and has represented several individuals and businesses in corporate and partnership disputes.
